Welcome to OnPoint Consulting NZ. By accessing or using our website and services, you agree to be bound by the following terms and conditions. Please read them carefully before engaging with our services.

1. Definitions

  • “Company,” “I”, “we,” “us,” “our” refers to OnPoint Consulting NZ.

  • “Client,” “you,” “your” refers to the individual or entity engaging with our services.

  • “Services” refers to any consultation, recruitment, HR, business improvement, compliance, or other professional services provided by Onpoint Consulting NZ.

  • “Website” refers to www.onpointconsulting.co.nz.

2. Acceptance of Terms

By using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our website or services.

3. Services Provided

Onpoint Consulting NZ offers a variety of professional services, including but not limited to:

  • HR Services

  • Recruitment Services

  • Business Improvement Services

  • Compliance Services

  • Health and Safety

  • Training

The scope of services will be outlined in a separate service agreement or proposal specific to each client.

4. Booking and Consultation

  • Initial Consultation: We offer a free 30-minute initial online consultation for new clients. This consultation is to discuss your needs and how we may assist you.

  • Booking: Clients can book consultations through our website. All bookings are subject to availability and will be confirmed via email.

  • Cancellations and Rescheduling: Clients may cancel or reschedule consultations at least 24 hours before the scheduled time. Cancellations made less than 24 hours in advance may incur a fee.

5. Fees and Payment

  • Service Fees: Fees for services will be outlined in a separate agreement or proposal. Our fixed-fee recruitment model is 11 to 14 percent cheaper per hire compared to other NZ recruitment agencies.

  • Payment Terms: Payment terms will be specified in the service agreement. Invoices must be paid within the time frame stated on the invoice unless otherwise agreed in writing.

  • Late Payments: Late payments may incur 20% interest charges at a rate specified in the service agreement or as per New Zealand law.

6. Client Obligations

  • Accurate Information: Clients must provide accurate and complete information to facilitate the provision of services.

  • Cooperation: Clients agree to cooperate fully with OnPoint Consulting NZ and provide necessary access to information and resources required to deliver the services.

  • Compliance: Clients are responsible for ensuring that their use of our services complies with all applicable laws and regulations.

7. Intellectual Property

  • Ownership: All intellectual property rights in any materials, documents, or deliverables provided by OnPoint Consulting NZ remain the property of the company unless otherwise agreed in writing.

  • License: Upon full payment for services, we grant the client a non-exclusive, non-transferable license to use the deliverables for their intended purpose.

8. Confidentiality

  • Client Information: We treat all client information as confidential and will not disclose it to any third party without the client’s consent, except as required by law.

  • Our Information: Clients agree to keep confidential any proprietary or sensitive information provided by OnPoint Consulting NZ.

9. Limitation of Liability

  • No Warranty: We provide our services on an “as is” basis without any warranties, express or implied.

  • Liability Limitation: OnPoint Consulting NZ’s total liability to the client for any claim arising out of or in connection with our services is limited to the amount paid by the client for the services in question.

  • No Consequential Damages: In no event will OnPoint Consulting NZ be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with our services.

10. Termination

  • By Client: The client may terminate the services by providing written notice to OnPoint Consulting NZ. The client will be responsible for any fees incurred up to the date of termination.

  • By Us: OnPoint Consulting NZ reserves the right to terminate services at any time if the client breaches these Terms and Conditions or if it is in the best interest of the company to do so.

11. Dispute Resolution

  • Negotiation: In the event of a dispute, both parties agree to first attempt to resolve the issue through good faith negotiation.

  • Mediation: If the dispute cannot be resolved through negotiation, it may be submitted to mediation before any legal proceedings are initiated.

  • Governing Law: These Terms and Conditions are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.

12. Changes to Terms and Conditions

We may update these Terms and Conditions from time to time. Any changes will be posted on this page, and the updated terms will take effect immediately upon posting.
